Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MonthFund website, application, and related services (collectively, the “Service”) operated by MonthFund (“MonthFund,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service. These Terms are provided for general information; have them reviewed by qualified counsel before relying on them for compliance decisions.

1. The Service

MonthFund provides software for calendar-style fundraising. Organizations run team campaigns; invited fundraisers share individual calendar pages; supporters claim days and make gifts. We also offer personal accounts for solo fundraisers who run a single calendar without a team. MonthFund is software only—we do not hold donor funds. Donations are processed by Stripe and paid to the connected account you or your organization configures.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information and notify us promptly of unauthorized use. Account types include organization workspaces and personal workspaces; features and fees differ by type (see Section 5 and Pricing).

3. Organizations, Fundraisers, and Personal Accounts

Organization administrators are responsible for their campaigns, participant invitations, public content, and compliance with applicable laws (including charitable solicitation, tax, and communications rules). Invited fundraisers are responsible for content on their pages and communications with their donors. Personal account owners operate a solo workspace: they onboard their own Stripe Connect account (typically Express), set campaign goals, and are solely responsible for representations made to donors about their cause.

MonthFund does not provide legal, tax, or accounting advice. Funds raised through Stripe Connect are paid to the connected account according to Stripe’s terms. You may convert a personal workspace to an organization workspace in product settings; history may be preserved subject to the convert flow.

5. Donations and Payments

Donations are processed by Stripe. By making or accepting a donation through the Service, you also agree to applicable Stripe and connected-account terms. Refund and dispute handling generally follow Stripe rules and the policies of the connected account receiving funds. MonthFund collects fees as disclosed at checkout and below.

Personal accounts: 5% platform fee on each donation (no monthly subscription). Organization accounts: 3% infrastructure fee on the Community plan; 1% on Professional; 0% on Network. Stripe card processing is separate.

Fees may be shown as an application fee on the connected account’s charge. Donors may optionally pay additional amounts to cover processing and platform fees so the fundraiser receives the intended gift. Current plan details: /pricing; personal accounts: /for-individuals. We may change fee schedules with notice as described in Section 13.

6. Communications

We may send transactional email and SMS related to your account and campaigns. Marketing email requires your consent. See our Privacy Policy and SMS Terms for opt-in and opt-out details.

7. Intellectual Property

MonthFund and its licensors own the Service, branding, and software. You retain rights to content you submit. You grant MonthFund a limited license to host, display, and process your content solely to operate the Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR SPECIFIC FUNDRAISING RESULTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTHFUND AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID MONTHFUND IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold MonthFund harmless from claims arising out of your use of the Service, your content, your campaigns, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may terminate or suspend your access with or without notice for breach of these Terms or operational reasons. Provisions that by nature should survive (limitations of liability, indemnity, governing law) survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.

13. Changes

We may modify these Terms by posting an updated version on this page. Material changes (including fee schedule changes) may be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.
